The plain-English rules for working with PostBoard Media, covering the shared postcard mailer and our agency and AI services.
The short version: PostBoard Media LLC sells ad slots on a shared neighborhood postcard and provides marketing, web, and AI services. You pay the fees we quote. We do solid work, but we do not guarantee leads, calls, sales, or any return on investment. Our liability is limited to what you paid us. Massachusetts law governs. This page is a plain-language template, not legal advice.
Agreement to terms
These Terms of Service ("Terms") are an agreement between you and PostBoard Media LLC ("PostBoard," "we," "us," or "our"). They cover your use of our website at https://www.postboardmedia.com and any service you buy from us. By using the site, contacting us to claim a slot, or hiring us for any service, you agree to these Terms. If you do not agree, please do not use the site or our services.
If you are agreeing on behalf of a business, you confirm you have the authority to bind that business to these Terms.
About our services
We offer two main things:
The PostBoard shared postcard mailer
PostBoard is a premium 9x12 shared postcard mailed to roughly 2,500 to 5,000 homes in a service area using USPS Every Door Direct Mail (EDDM). Each card holds up to 16 advertiser slots. We enforce strict one-business-per-category exclusivity, so a direct competitor in your category will not appear on the same card for the same drop. Professional ad design is included, and each ad carries a QR code for scan tracking.
Agency and AI services
We also provide web development, digital marketing, and AI automation. This includes our "AI Blueprint" assessment and AI voice agents. The specific scope, deliverables, and price for any agency or AI engagement are set out in the quote or proposal we send you for that project.
Bookings, slots, and category exclusivity
Ad slots are limited and are sold on a first-come basis subject to availability and our print schedule. A slot is not reserved until we confirm your category is open and you complete the steps we describe to claim it.
One business per category per card per drop. Once a category is claimed for a given drop, it is locked for that drop. Exclusivity applies to a single card and a single drop. It is not a promise of exclusivity across other cards, other drops, other towns, or any other channel.
Slots and drop dates depend on the print schedule and on filling enough advertisers to run a card. We may adjust a drop date, a route, or a home count when print, postal, or production conditions require it. If we cannot run a drop you paid for, your options are described under Quotes, fees, and payment.
Quotes, fees, and payment
Fees are as quoted to you for the specific slot, bundle, or project. Prices on the website may change at any time, but a price we quote to you for a defined scope holds for that engagement.
We do not currently take payments on the website. Today the process is to contact us to claim a slot, and we arrange payment separately. When we add online payments, they will be processed by a third-party payment processor (Stripe). PostBoard does not store your full card details; the processor handles card data under its own terms and security practices.
You are responsible for any applicable taxes, except for taxes based on our net income. Unless a quote says otherwise, fees are due before we begin print or production. If we are unable to run a drop you have paid for and we cannot agree on a replacement drop, we will refund the amount you paid for that slot.
No guarantee of results
This matters, so we will be direct: we do not guarantee leads, phone calls, scans, sales, revenue, or any specific return on investment. Marketing outcomes vary based on your offer, your pricing, your reputation, your follow-up, timing, the market, and many factors outside our control.
Any examples, response-rate math, or scenarios we show are illustrations, not promises. We give you tracking data so you can see what actually happened, and we help you improve your offer, but we cannot and do not promise a result.
Client responsibilities
To do good work we rely on you to:
- Give us accurate and complete information about your business, offer, and contact details.
- Confirm you own or have the rights to any logos, photos, text, trademarks, or other materials you provide, and that we may use them to create and run your ad or project.
- Make sure your offer and claims are truthful, legal, and honored as advertised.
- Review and approve proofs, designs, and deliverables on time. Print and launch deadlines depend on timely approvals, and delays on your side may move you to a later drop.
You are responsible for the content you ask us to publish on your behalf.
Intellectual property
The PostBoard name, logo, website, the shared-card format, and our own materials and methods belong to PostBoard Media LLC. Nothing in these Terms transfers our intellectual property to you.
Materials you provide remain yours. By giving them to us, you grant us a license to use them to produce, print, and run your ad or project and to show your finished work as an example of ours. Custom deliverables we create for a paid project become yours once that project is paid in full, except for any third-party assets, our pre-existing tools and templates, and general know-how, which remain owned by their owners or by us.
Third-party services
We use third-party tools to run our business and deliver services. These can include Cal.com for scheduling, Vapi for AI voice agents, Resend for email, Supabase for data storage, Stripe for payments, Apify for data collection, USPS for mail delivery, and similar providers. Each is governed by its own terms and privacy policies. We are not responsible for third-party services, their availability, or their actions, and your use of features powered by them may be subject to their terms.
Disclaimers and limitation of liability
Our website and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted or error-free, or that any marketing effort will produce a particular outcome.
To the fullest extent permitted by law, PostBoard Media LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost business. To the fullest extent permitted by law, our total liability for any claim relating to the site or our services is limited to the amount you actually paid us for the specific service that gave rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless PostBoard Media LLC and its owner from any claims, damages, losses, and reasonable costs (including legal fees) that arise from the content or materials you provide, from your offer or business practices, or from your breach of these Terms or of any law.
Termination
Either of us may end an ongoing engagement as described in the relevant quote or proposal, or with reasonable notice if no term is stated. We may suspend or end your access to the site or to a service if you breach these Terms, fail to pay, or use a service unlawfully. Fees for work already performed or for production already committed are non-refundable, except where these Terms say otherwise. Sections that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, indemnification, and governing law) survive termination.
Changes to terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Changes apply going forward. If you keep using the site or our services after we post an update, that means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or our services will be handled in the state or federal courts located in Massachusetts, and you agree to that jurisdiction.
